AstraZeneca and Zydus settle Nexium patent dispute

AstraZeneca and Zydus Pharmaceuticals have entered into a settlement agreement over a patent dispute centring on heartburn drug Nexium (esomeprazole).

A consent judgment was filed by Judge Mary Cooper on Wednesday, March 15 at the US District Court for the District of New Jersey, dismissing the action without prejudice.

The dispute between the two companies arose in July 2015 after Zydus filed an Abbreviated New Drug Application with the Food and Drug Administration seeking to manufacture a generic of Nexium.

AstraZeneca, in its lawsuit, alleged that Zydus would infringe US patent numbers 6,369,085; 7,411,070; and 8,466,175.

Although no information regarding the settlement was disclosed, AstraZeneca had initially asked for the generic company to be permanently enjoined from bringing its drug to market.
