Thermo Fisher Scientific has agreed a $35 million settlement with Enzo Biochem in a patent infringement fight in a Delaware federal court over a pair of DNA testing patents.
The lawsuit, one of 11 infringement claims that Enzo filed against Thermo, centres on US patent numbers 6,992,180 and 7,064,197, which cover specific nucleotides and nucleic acids used in the mapping of genes.
Four of the suits have now been resolved while seven are still pending. This case was filed in the US District Court for the District of Delaware.
The settlement does not influence a separate patent litigation filed in Connecticut that is on appeal at the US Court of Appeals for the Federal Circuit.
