QXMédical seeks declaration of non-infringement

Medical device company QXMédical has filed a lawsuit against rival Vascular Solutions, denying infringement of Vascular’s patents.

Filed on Friday, June 9, at the US District Court for the District of Minnesota, the lawsuit sought a declaratory judgment of non-infringement of six patents.

QXMédical had been accused by Vascular of having infringed six of its patents by selling the product Boosting Catheter, an interventional device for coronary and peripheral vessels.

In April this year, Vascular sent a letter to QXMédical, claiming that Boosting Catheter had infringed US patents 8,048,032; 8,142,413; RE45,380; RE45,760; RE45,776; and RE46,116, relating to a technology similar to that used in Boosting Catheter.

According to the claim, Vascular’s attorney had requested a sample of the Boosting Catheter in order to analyse the infringement further.

QXMédical has asked the court for judgment declaring that its product does not infringe any of the patents belonging to Vascular.

The company has also demanded jury trial.
