Thermo Fisher dismisses patent action against DeNovix
Biotech company Thermo Fisher Scientific has dismissed its patent infringement action against DeNovix, US-based instrumentation business.
In November last year, Thermo Fisher accused DeNovix of infringing two patents covering Thermo Fisher’s NanoDrop micro-volume spectrophotometers.
Spectrophotometers allow users to measure the concentration and purity of DNA, RNA and proteins in extremely small samples.
Thermo Fisher obtained the patents when it acquired NanoDrop Technologies in 2007.
According to the complaint, which was filed at the US District Court for the District of Massachusetts, DeNovix infringed through the sale of its DS-11 family of spectrophotometers.
The two patents involved were US numbers 6,628,382 and 6,809,826.
On Wednesday, August 9, Thermo Fisher filed its notice of dismissal.
“DeNovix takes IP protection very seriously and completely disagreed that infringement ever occurred,” said the company in a press release, published on August 9.
It added that the company is “very familiar” with the patents because NanoDrop filed them while Fred Kielhorn, who is now the co-founder and CEO of DeNovix, was its president.
