Toshiba Medical settles patent dispute with NeuroGrafix

Medical technology company NeuroGrafix and Toshiba Medical have entered into a settlement agreement following a patent dispute over MRI imaging technology.

The settlement, which was filed on Friday, April 14, at the US District Court for the District of Massachusetts, also asked the court for a 60-day stay to finalise settlement terms.

In 2013, ten actions filed by NeuroGrafix were consolidated.

NeuroGrafix sued Toshiba in January 2015, claiming that Toshiba had infringed its US patent number 5,560,360, called “Image neurography and diffusion anisotropy imaging”.

The claim was consolidated with the other actions at the Massachusetts court.

According to the complaint against Toshiba, NeuroGrafix had shared its business plan with Toshiba in 2000.

NeuroGrafix had allegedly met in person with senior Toshiba management in Japan, where the business plan was revealed and other relevant discussions were held.

At the time, Toshiba had allegedly disclosed the ‘360 patent and discussed the potential for Toshiba to gain an exclusive licence to the patent.

The complaint alleged that Toshiba had infringed the patent by making use of and selling equipment and methods protected by the patent.

Some of the allegedly infringing products were Toshiba Vantage Titan 3T, Toshiba Vantage, Toshiba Excelart, among others.
