Medical device company Boston Scientific has filed a complaint against Nevro for allegedly infringing ten of its patents.
The suit, which was filed on Friday, December 9 in the US District Court for the District of Delaware, centres on the Senza spinal cord stimulation system, produced by Nevro.
The main claim of infringement made in the suit was Nevro’s bringing to market of Senza before the patents covering the technology behind the product expire.
Nevro was granted approval by the Food and Drug Administration in May 2015 to treat pain without tingling sensation.
Boston Scientific stated in its complaint: “Boston Scientific has been damaged as a result of Nevro’s infringing conduct and is entitled to recover damages and adequately compensate it for Nevro’s infringement.”
Following the suit, Boston Scientific has asked the court for a judgment that Nevro has infringed claims of its patents.
It has also asked the court to be awarded costs and expenses.
It comes after Nevro itself filed a patent lawsuit against Boston Scientific in November, asserting that Boston Scientific has infringed Nevro's patents covering Senza.
