USITC investigates Fujifilm over X-ray devices
The US International Trade Commission (ITC) has begun an investigation into Fujifilm over certain X-ray breast imaging devices.
On Wednesday, July 26, the ITC announced it would investigate based on a complaint filed by Hologic.
Hologic, a manufacturer of medical imaging systems, claimed that Japan-based Fujifilm, and its subsidiaries Fujifilm Medical Systems USA and Fujifilm Techno Products, had infringed its patents.
According to the complaint, filed in June this year, Fujifilm has infringed five of Hologic’s patents including US number 7,831,296, which covers “X-ray mammography with tomosynthesis”.
The complaint accuses Fujifilm of violating section 337 of the Tariff Act of 1930 by importing the goods into the US and selling them.
Hologic has asked the ITC to issue a limited exclusion order and cease-and-desist orders.
The ITC’s chief administrative law judge (ALJ) will assign the case to another ALJ, who will hold an evidentiary hearing and make an initial determination on whether section 337 has been violated.
The commission added that it will make a final determination at the earliest practicable time and will set a target date for completing the investigation within 45 days after institution.
