Enzo settles second of 12 patent lawsuits

Enzo Life Sciences has agreed to settle a patent infringement dispute with Siemens Healthcare Diagnostics, in what was one of 12 cases that Enzo had filed simultaneously.

According to Enzo, it will receive an “upfront payment of $9.5 million” from Siemens plus potential licensing royalties that could stretch to $5 million.

The dispute centred on US patent number 7,064,197, called “System, array and non-porous solid support comprising fixed or immobilised nucleic acids”.

Enzo claimed that Siemens had infringed its patent through several versions of Versant kPCR Molecular System, a molecular testing tool.

The settlement was announced by Enzo in a filing with the US Securities and Exchange Commission on Monday, July 20.

The case was one of 12 lawsuits that Enzo filed at the US District Court for the District of Delaware in April 2012.

Of those 12 lawsuits, ten remain active.

The only other settlement so far was between Enzo and Luminex, which was finalised earlier this month when Luminex agreed to pay Enzo $7.1 million.

Enzo Life Sciences is a subsidiary of Enzo Biochem.
