Stryker wins injunction and damages in Zimmer case

A Michigan district court has ruled in favour of Stryker in a patent case against medical device company Zimmer after it was found to have infringed three patents belonging to Stryker.

The decision was handed down on Wednesday, July 12, at the US District Court for the Western District of Michigan.

The ruling came after a previous US Supreme Court decision, handed down in July 2016,  which favoured Stryker by finding that Zimmer had infringed Stryker’s patents covering a surgical device.

Counterclaims by Zimmer were dismissed by the court, while it said that Stryker is entitled to triple damages on its lost profits (which totalled $70 million), as well as supplemental damages ($6.1 million). Other fees and costs were also awarded.

Stryker sued Zimmer back in 2012 for infringing US patent numbers  6,022,329; 6,179,807; and 7,144,383.

In the latest ruling, Zimmer was also enjoined from selling infringing medical devices.

The court said: “Zimmer Inc. and Zimmer Surgical, Inc. are hereby permanently enjoined from the manufacture, use, importation, sale, or offer for sale within the US of the pulsed lavage products found to infringe claims 45, 50, 51, and 52 of US patent number 6,179,807, and products no more than colourably different therefrom.”

A pulse lavage is a surgical cleaning device.
