Sun Pharma sued over IBS generic drug

Forest Laboratories and Allergan have filed a complaint against generic company Sun Pharma for patent infringement.

The case was filed on Friday, June 30, at the US District Court for the District of Delaware.

Forest and Allergan sued Sun Pharma after the company filed an Abbreviated New Drug Application with the Food and Drug Administration seeking permission to market Linzess (linaclotide).

The patent involved is US number 8,933,030.

Linzess is used to treat chronic constipation and chronic irritable bowel syndrome.

The suing companies have asked the court to enjoin Sun Pharma from bringing the generic drug to market.

They have also asked to be awarded monetary relief if Sun Pharma sells the generic drug, as well as an award of attorneys’ fees for bringing the case to action.
