Illumina and Cornell University seek to dismiss patent dispute

Genetic sequencing company Illumina and Cornell University have together sought to dismiss a patent dispute over eight genetic testing patents belonging to Cornell.

A joint stipulation to dismiss the case was filed on Tuesday, April 18 at the US District Court for the District of Delaware.

Both parties have come to an agreement for each to pay its own fees and costs. Cornell’s fee submission was also withdrawn.

The case arose back in May 2010 when Cornell, together with its exclusive licence holder Life Technologies, sued Illumina. Life Technologies had been granted rights to each patent-in-suit.

All the patents involved cover “Detection of nucleic acid sequence differences using couple ligase detection and polymerase chain reactions”.

In 2010, Cornell was seeking a permanent injunction, as well as an award for damages for the alleged infringement.

According to the complaint, Illumina had been selling instruments and kits for genetic analysis which infringe the patents.

One of the allegedly infringing products was the Illumina GoldenGate Genotyping Assay, which can detect nucleic acid sequence differences.
