MyMedicalRecords sues over online health checks
A US company which provides secure personal medical records online has filed a patent infringement case against a rival health-care company.
MyMedicalRecords (MMR), a subsidiary of MMRGlobal, claims Allscripts Healthcare Solutions (AHS) is infringing on its patents for its personal health record (PHR) system.
Filed at the US District Court for the Central District of California, the complaint relates to US patent number 8,301,466, entitled, "method and system for providing online records," and patent number 8,498,883, "method for providing a user with a service for accessing and collecting prescriptions."
The complaint, filed on September 24, claims that, after acquiring the assets of health management company Jardogs LLC, earlier this year, Allscripts has provided the FollowMyHealth (FMH) service.
MMR claims the FMH model, which implements methods for providing a user with the ability to access and collect PHRs and provides the ability to access, collect, and manage drug prescriptions, infringes on the patents.
According to the complaint, AHS “has contributorily infringed and is currently contributorily infringing the '883 patent by making, using, offering for sale, and/or selling in the US certain methods or systems disclosed and claimed in the patent.”
MMR is seeking monetary damages as well as a permanent injunction.
“As a direct and proximate result of the defendant’s conduct, plaintiff has suffered, and will continue to suffer, irreparable injury for which it has no adequate remedy at law.
“Plaintiff also has been damaged and, until an injunction issues, will continue to be damaged in an amount yet to be determined,” the complaint adds.
Robert Lorsch, global chief executive of MMR, said, “while MMR's business is primarily selling our PHR products and services, we remain focused on the monetisation of our patents and other intellectual property both domestically and internationally.”
California-based MMR has eight US patents as well as pending applications around the world including, Australia, Canada, China, Japan and Europe.
