The “for research use only“ label – a free licence to commercialise patented medical products?

Following the entering into force of Regulation (EU) 2017/746 of the European Parliament on in vitro diagnostic medical devices, an increasing number of medical products labelled “for research use only” rather than products bearing CE marking will be launched. Implications for patent litigation will be discussed based on relevant case law.
