Boston Scientific and Abbott caught up in patent claim

A physician at Aurora Health Care has filed patent infringement complaints against  Boston Scientific,  St Jude Medical and Abbott Laboratories.

Imran Niazi filed two separate lawsuits against the three companies on Thursday, March 9, at the US District Court for the Western District of Wisconsin.

Niazi, who is an electrophysiologist treating patients with heart rhythm disorders, alleged that the medical companies had infringed a patent owned by him.

The patent in dispute is US number 6,638,268, called “Catheter to cannulate the coronary sinus”, and was issued in October 2003.

According to the complaints, Boston Scientific has infringed the patent by selling a “telescoping catheter system” called Acuity. St Jude and Abbott sell a similar product under the name CPS.

Niazi has asked the court to enter a judgment in his favour, holding that the sued companies have wilfully infringed the patent.

He has also requested that the companies should be enjoined from selling their allegedly infringing products, along with an award of damages and a jury trial.
