Horizon sues Actavis for Pennsaid patent infringement

Horizon Pharma has sued Actavis for allegedly infringing four of its patents.

The case, filed at the US District Court for the District of New Jersey yesterday, August 18, arose after Actavis sought approval from the US Food and Drug Administration to market a generic version of Pennsaid (diclofenac).

Pennsaid is used to treat knee pain caused by osteoarthritis.

Actavis applied for an Abbreviated New Drug Application seeking approval to market the generic before the expiration of the Horizon-owned patents in 2029.

The patents asserted in the suit are U S numbers 9,339,551; 9,375,412; 9,339,552 and 9,370,501.
