NuScience urges court to take action over Cellfood trade secret threats

NuScience, a US based nutritional supplement company, has asked a court to imprison two brothers who are at the centre of a trade secrets lawsuit.

The dispute arose after brothers Michael and Robert Henkel allegedly threatened to manufacture a product using NuScience’s formula for Cellfood and sell it to the public.

The brothers also reportedly threatened to reveal trade secret-protected ingredients related to the product and harassed NuScience’s customers and other people involved with the company, including its owner.

Cellfood is a nutritional supplement marketed as an “oxygen+nutrient supplement”.

In the complaint, filed at the US District Court Central District of California on August 5, NuScience said the Henkel brothers had been “posting thinly veiled threats of violence”.

Michael Henkel also made threats on social networking site Facebook regarding both the sale of NuScience’s products and directly to NuScience’s owner Kevin Negrete.

The court previously issued an arrest warrant against the brothers last year but has failed to act on it, according to the complaint.

The case stems from a secret formula developed by a man named Everett Storey who died in the 1980s, on which both NuScience’s and the Henkel brothers’ formulas are allegedly based.

NuScience and the brothers both claim to have obtained the formula legally from Storey.

Henkel says Storey gave it to him before dying while NuScience said it bought the formula from Storey's family after his death.

Although Michael Henkel’s posting on Facebook has stopped, he has started a Twitter page under the name @CellfoodTruth, where he continues to post about Cellfood on a daily basis, according to the complaint .
