Patent battle over migraine relief supplement

A dietary supplement, MigreLief, is at the centre of a patent dispute between Akeso Health Sciences and Family Tree Remedies.

Dietary supplement company Akeso has sued Family Tree Remedies, a company focusing primarily on migraine supplement solutions, alleging infringement of US patent number 6,500,450.

The case was filed yesterday, November 2 in the US District Court for the Central District of California, Western Division.

The ‘450 patent is called “Composition for treating migraine headaches”, and was issued by the US Patent and Trademark Office in December 2002. It claims a combination of feverfew plant extract (parthenolide), magnesium, and riboflavin.

According to the complaint, Family Tree allegedly infringed the ‘450 patent by selling its Preventa Migraine product, which contains the same ingredie nts.

Akeso is seeking compensation and damages, as well as a jury trial.
