Gilead wins second Sovaldi domain dispute

The Alternative Dispute Resolution Forum has ruled in a case between Gilead Sciences and a company called PublicDomainRegistry.com, in another battle centred on Gilead’s hepatitis C drug Sovaldi (sofosbuvir).

Gilead alleged that the owner of the sovaldicostindia.com domain infringed a trademark it owns for ‘Sovaldi’.

In a ruling handed down on July 28, the Forum agreed and transferred the domain to Gilead.

Gilead filed its complaint on June 17. On June 21, the Forum wrote a notice to the registrant asking for a response and gave a deadline of July 11.

However, the domain name owner did not respond.

In the judgment, panelist Ho Hyun Nahm, found that the domain name was confusingly similar to Gilead’s trademark, that the owner had no rights or legitimate interest in the domain and that it had been registered in bad faith.

It is the second time in recent weeks that Gilead has won a domain dispute related to Sovaldi.

Last month, LSIPR reported that the ordersovaldi.com domain had also been transferred to the p harmaceutical company.
